Dear Ms. Brookins-Hudson:

This responds to your request for an opinion indicating whether Councilmember Jack Evans should recuse himself from deliberations and voting on Bill 11-585 because he has a mortgage loan application pending with the Franklin Bank.  You indicated that Franklin Bank would benefit from the passage of the Bill.

In our telephone conversation today, you stated that Councilmember Evans has withdrawn the loan application and will recuse himself from voting and deliberations on Bill 11-585.  It is the opinion of the Office of Campaign Finance that he has taken the correct actions to avoid a conflict of interest in this matter.
